What is an Aadhaar Card?

Aadhaar is a centralised system of identification using a 12-digit number that is linked to biometric data. It is designed to replace all previous methods of identification in India such as birth certificates and ration cards that are prone to loss and damage of records.

Benefits / Usage of Aadhaar for NRI
As an NRI, you will need a valid Government of India issued identity document to make any financial transactions in India. An Aadhaar card or its digital version e-Aadhaar is one such document. This article explains how you can apply for an Aadhaar card and its benefits.


Can an NRI get an Aadhaar Card?

Initially, the Aadhaar Card was accessible only to Indian residents. NRIs who wished to apply for one had to reside in India for a minimum of 182 days before they could enrol for it.

However, in July 2019, the Government released an intimation to ensure quicker processing for NRIs with "Aadhaar on Arrival". The amendment to the bill proposed that the Unique Identification Authority of India (UIDAI) will now issue Aadhaar cards on arrival to NRIs who hold Indian passports as opposed to the traditional method of waiting for a mandatory 182 days.

While the duration has been shortened, the procedure for the application for NRIs remains the same.


How can an NRI get an Aadhaar Card?

The procedure and requirements for an Aadhaar Card for an NRI are similar to the ones for Indian citizens. The process comprises the following steps:

1. Book an appointment

You can book your Aadhaar appointment online or offline.

Online: Visit the UIDAI website, choose your location, provide your India mobile number and book an appointment slot. You can book an appointment even before you arrive in India.

Offline: You can directly visit an Aadhaar centre near you to set up a biometric appointment.

Though an appointment can be booked online or offline, you are required to be physically present to complete the biometric authentication for the Aadhaar card.

2. Submit the documents

Next, you will need to submit all the necessary documents that establish your identity. Following are the UIDAI approved documents required for Aadhaar card for NRIs:

A valid Indian passport is accepted as proof of identity and proof of address

In case a valid Indian address proof is missing, you can submit any of the other UIDAI approved Proof of Address (PoA) documents.

You may be asked for other documents for evidence of your residency status with another country i.e. a photocopy of your stamped visa of the country you're residing in.

You must submit these documents in person when you visit the UIDAI enrolment centre. Do carry the originals along for verification.

3. Be present for biometric data collection

After providing the necessary information as well as all the required documents, you need to visit the UIDAI enrolment centre to record your biometric details. An official will capture the below biometric data:

A scan of all ten fingers

A scan of irises of both eyes

A photograph

That's it. Your card will be sent to your registered address in India.

The process to generate your Aadhaar after enrolment may take up to 90 days.

e-Aadhaar – How to get it and its benefits

After you've applied for the Aadhaar card, you can get a digital version of it i.e. the e-Aadhaar. The e-Aadhaar is considered a valid address and identity proof document as it contains all the same details as the physical card including your name, address, photograph and date of birth. Here's how you can get your e-Aadhaar:

Visit the UIDAI website

Enter your 12-Digit Aadhaar number. If you haven't received it yet, you can enter your Aadhaar enrolment number along with the time and date of the application as mentioned on the acknowledgement receipt.

Click on the tab 'Get One Time Password' post which you will receive an OTP on your registered mobile number (RMN). Enter the OTP.

Enter the first four letters of your name along with your year of birth in YYYY format to open the PDF file containing the e-Aadhaar and download the same on your smartphone or laptop. Please note that you will need Adobe Reader on your laptop or mobile to open the file.

Uses of Aadhaar and e-Aadhaar for NRIs

You can use the Aadhaar card as a unique identifier and as a KYC document for any financial or regulatory transaction in India.

Q&A regarding Aadhaar For NRI:

1. Can an NRI apply for Aadhaar?

YES. An NRI (whether minor or adult) with a valid Indian Passport can apply for Aadhaar from any Aadhaar Kendra.

2. Can my passport be used for Aadhaar update of my spouse?

If your passport has the name of your spouse, then it can be used as Proof of Address for them.

3. I am an NRI and I have an Aadhaar. Can my spouse be enrolled based on my Aadhaar & passport?keyboard_arrow_up

If spouse is NRI - valid Indian passport of the applicant is mandatory as Proof of Identity (PoI).

If spouse is an Indian resident (not NRI) – any valid Proof of Relationship document (refer: https://uidai.gov.in/images/commdoc/valid_documents_list.pdf) including your Passport (having name of your spouse) can be used for enrolment under Head of Family (HoF).

4. What is the process for Aadhaar enrolment for children of NRIs?

Pls refer to the below:

Child is below 5 years of age:

One of the parents/ guardian has to authenticate on behalf of the child and also give consent for enrolment of the minor by signing the enrolment form.

If the child is an NRI - valid Indian passport of the child is mandatory as Proof of Identity (PoI)

If the child is an Indian resident (not NRI) - any valid Proof of Relationship document (refer: https://uidai.gov.in/images/commdoc/valid_documents_list.pdf) such as Birth Certificate, along with Aadhaar of the parent/ guardian, can be used for enrolment.

Child is between 5 to 18 years of age:

One of the parents/ guardian has to give consent for enrolment of the minor by signing the enrolment form.

If the minor is an NRI – valid Indian passport of the child is mandatory as Proof of Identity (PoI)

If the minor is an Indian resident (not NRI) -

No document in the name of the minor: any valid Proof of Relationship document (refer: https://uidai.gov.in/images/commdoc/valid_documents_list.pdf) such as Birth certificate can be used for enrolment under Head of Family.

Minor has a document: use a valid Proof of Identity (PoI) and Proof of Address (PoA) document (like School ID card) in the child’s name for enrolment (refer: https://uidai.gov.in/images/commdoc/valid_documents_list.pdf).

5. Can I give an International mobile number in my Aadhaar details?

Currently, we do not support international/ non-Indian mobile numbers.

6. The address in my passport is not updated. I want to give my present address for my Aadhaar application. Is that possible?

YES. A valid Indian Passport is mandatory as a Proof of Identity (PoI) for NRI applicants. You may choose to give any other Indian Address with a valid supporting Proof of Address (PoA) as per the list of documents acceptable by UIDAI: https://uidai.gov.in/images/commdoc/valid_documents_list.pdf

7. What is the process for NRI enrolment?

The process is:

Visit any Aadhaar Kendra of your convenience.

Carry valid Indian Passport with you

Fill details in the enrolment form

Giving Email ID is mandatory for NRI

The declaration for NRI enrolment is slightly different. Read and sign the same in your enrolment form

Ask the operator to enroll you as NRI

Give your Passport as Proof of Identity

You may choose to use your Passport itself as Proof of Address and Date of Birth proof or give some other valid document/s for this (As per https://uidai.gov.in/images/commdoc/valid_documents_list.pdf)

Complete the biometric capture process

Check all details on screen (in English and local language) before you allow the operator to submit

Collect the acknowledgement slip/ enrolment slip that has your 14 digit Enrolment ID and Date & Time Stamp. You can check status of your Aadhaar from: https://resident.uidai.gov.in/check-aadhaar

The income tax department has announced that failure to link the cards will attract a fine of INR1,000 (£9.91, $13.63, €11.61) and the PAN card will become invalid for financial transactions after the deadline of 31 March 2021.

The linking, aimed to make financial transactions transparent and to nab tax evaders, was stipulated in the Finance Bill 2021 passed in parliament.

It is mandatory for every person to quote the Aadhaar number in their income tax return and the application for the allotment of PAN, provided they are eligible for Aadhaar.

The government has, in the past, given several extensions to link the cards.

But now, as per the Finance Bill, 2021, it has introduced an amendment under which a person will be liable to pay a late fee of up to INR1,000 in case of non-linking of PAN with Aadhaar.

Invalid PAN card

As per section 234H, added to the Income Tax Act 1961 under the Finance Bill 2021, it is necessary to link the PAN card to Aadhar on or before the deadline provided by the government.

If not linked, the PAN card will become invalid and cannot be used for financial transactions after the due date.

If the PAN card is rendered invalid, it will affect a variety of financial services such as opening bank accounts, demat accounts for NRIs to invest in the Indian markets, all types of banking services and investing in mutual funds.

In case a person is required to furnish or intimate his PAN and the PAN is inoperative, it will be deemed that he or she has not furnished their number.

Under various provisions of the Income Tax Act, if a person does not furnish their PAN or gives an inoperative PAN he or she may have to a pay a higher TDS (tax deducted at source) or TCS (tax collected at source), and may not be able to file income tax return and may face the consequences of not filing the tax return.

Extension unlikely

Though the deadline to link the cards is unlikely to be extended beyond the deadline, NRIs hope the authorities will budge.

“It is highly unlikely that the deadline will be extended as the budget proposals are scheduled to be effective from April 1, 2021 as linking of the cards is one of the budget proposals,” said KV Shamsudheen, chairman of Pravasi Bandhu Charitable Trust, an NGO espousing NRI issues, who spearheaded a campaign to make NRI eligible for Aadhaar card issuance.

“However, exemptions can be made, in this case, in view of the inability of several NRIs to link the cards who are unaware of the deadline and the implications.”

Earlier, NRIs were ineligible for Aadhaar card as it was issued to resident Indians only.

A resident Indian is defined as one who stayed in India continuously for more than 182 days in a year.  If an NRI stayed in the country for more than 182 days, his NRI status will become invalid.

Later this period was reduced to 120 days in the 2020-21 budget. However, the government later decided that NRIs can also be issued the national ID card.

But a majority of NRIs did not bother to get the card as it was not mandatory.

Similarly, many NRIs did not apply for the PAN card for the fear of being included in India’s tax net.  Every person who has been allotted PAN as of 1 July 2017 and who is eligible to obtain Aadhaar number is required to link his PAN to Aadhaar.

PAN can be linked to Aadhaar through SMS services also. Send SMS to 567678 or 56161 from the registered mobile number.

    If a person is eligible to obtain an Aadhaar Card (Number) then it is mandatory to quote the Aadhaar Number or the 28 digit enrolment id while applying for Permanent Account Number (PAN) Card in form 49A (for Indian Nationals) and while filing their Income Tax Returns.
    Section 139AA (2)
    For every person who is eligible to obtain an Aadhaar Card, it is mandatory to link the Aadhaar Card with the PAN Card before the prescribed due date.
    Important Pointers:
    • The due date has been extended to 30th September, 2021 from the previous date 30th June, 2021 by the central government.
    • Failing to link Aadhaar and PAN Card will result in the PAN Card being inoperative /invalid from 1st October, 2021.
    • The individual with an ineffective PAN Card shall be liable to face consequences as if he had not applied/allotted/furnished/quoted the PAN Card.

    As per the [notification number 37/2017, F. No. 370133/6/2017-TPL], the government notifies that the provisions of the section 139AA shall not apply to an individual who does not possess the Aadhaar number or the Enrolment ID and is:-
    • Residing in the States of Assam, Jammu and Kashmir and Meghalaya;
    • A non-resident as per the Income-tax Act, 1961;
    • Of the age of eighty years or more at any time during the previous year;
    • Not a citizen of India.
    Conclusion: This simply translates to the fact that if you are an NRI, a Foreign Citizen, a super senior citizen, or an individual from Assam, J&K and Meghalaya, then it is not mandatory for you to obtain an Aadhaar and eventually it is not mandatory to link it to the PAN Card.
    Quick Question: Is it possible to link PAN with Aadhaar after it becomes inoperative/ invalid?

  3. Answer: YES! You can link your PAN Card with Aadhaar after it has become inoperative. Your PAN Card will become active once again as soon as it gets linked to the Aadhaar Card.
    Note: The penalty/fees u/s 234H shall be levied when the person will link/intimate the Aadhaar after it becomes inoperative.
    Aadhaar Enrolment for NRIs and OCIs: An Overview
    Only Residents of India are eligible to enrol for an Aadhaar Card and it is mandatory for them to obtain one. NRIs can enrol for an Aadhar Card if they want to but it isn’t mandatory for them to do so. In 2019, the government removed the 182 days waiting period for NRIs. They can apply for an Aadhar Card when they come to India without any waiting period with an Indian Passport. Also, OCIs who have stayed in India for more than 182 days are eligible to enrol for an Aadhar Card.

    The above provisions apply to persons who are eligible to get Aadhaar. Under section 3 of the Aadhaar Act 2016, only a resident is entitled to get Aadhaar.
    Therefore, the provisions of Section 139AA quoted above regarding linking of Aadhaar to PAN or the requirement of quoting the Aadhaar number in the return shall not apply to a non resident, who is not eligible to get Aadhaar.”
    Consequences of not linking PAN with Aadhar Card
    There are various consequences of not linking PAN and Aadhar Card for eligible individuals under the IT Act 1961, which are:
    • Section 206AA: TDS will be deducted at a higher rate
    • Section 206CC: TCS would be collected at a higher rate
    • Section 234A, 234B, 234C: Taxpayers will not be able to file their ITRs; Penalty of up to Rs.10,000/- u/s 234F
    • Section 234H: Taxpayer will only be able to make the PAN operative after linking with the Aadhar Card and paying a fees/penalty of up to Rs.1000/-
    • Section 272B: It is mandatory to quote PAN for certain financial transactions as per section 139A. If the PAN is not linked, it will become inoperative/invalid and this would result in non-compliance with the provisions of Section 139A which would attract a penalty up to Rs.10,000/- u/s 272B.
    What to do to make sure that no penalties are levied for PAN Aadhaar Linking for NRI?
    In order to get around the issue and avoid any discrepancies, individuals for whom it isn’t mandatory to obtain an Aadhar Card (NRIs and OCIs living abroad) must do the following to avoid any chances of penalties or non-operation of PAN Card by 30th September, 2021:
    • Visit your Income Tax e-filing portal
    • Visit “My Profile” Section
    • Under Contact details change your Residential Status to Non-Resident
